Terms and Conditions

1. PROGRAM DESCRIPTION. North Coast Electric Company (the “Company”) values its customers and has committed to certain customer service guarantees through a program called Deliver on the Promise (the “Program”). Specifically, the Company guarantees that: (1) customer orders will be 100% accurate; (2) when a customer with a Company account returns resalable stock material, a credit will be posted to the customer’s account by the end of the next business day; (3) items on the Company’s Top 500 Product list, a copy of which is available upon request, will never be out of stock; and (4) call ahead “will call” orders will be ready in 25 minutes or less (collectively, the “Customer Service Guarantees”). 

THE FOREGOING NOTWITHSTANDING, THE COMPANY’S PRODUCTS AND SERVICES ARE SUBJECT TO, AND GOVERNED EXCLUSIVELY BY, ITS TERMS AND CONDITIONS OF SALE, WHICH ARE INCORPORATED HEREIN AND AVAILABLE AT: https://www.northcoast.com/about/terms.  EXCEPT FOR THE LIMITED CREDIT PROVIDED FOR UNDER THIS PROGRAM, ALL OTHER AND/OR CONFLICTING TERMS ARE REJECTED, VOID, AND OF NO FORCE OR EFFECT. THESE TERMS AND CONDITIONS DO NOT AFFECT ANY MANUFACTURER’S WARRANTY OR REQUIREMENTS, LIMITATIONS, OR RESTRICTIONS, WHICH MAY VARY BY PRODUCT OR SERVICE.

2. AWARD OF CREDIT. If the Company does not meet one or more of the Customer Service Guarantees in fulfilling an order, the customer may request a $25 Customer Service Guarantee Credit (the “Credit”) by visiting https://www.northcoast.com/services/services/dotp. All requests for Credit must be made within thirty days from the date of the corresponding order.

 The Credit may be used to offset an outstanding account balance or on a single future order. When used toward a future order, the entire Credit must be used, and any remaining balance will not be refunded. The Credit must be redeemed within one year from the date it is issued. Customers are only eligible to receive a single $25 Credit per order, even if there is more than one Customer Service Guarantee that the Company does not meet.

3.  PROGRAM ELIGIBILITY: The Company’s customers in Alaska, Arizona, Idaho, Montana, Washington, and Oregon are eligible to receive Credit under the Program. The Company’s officers, directors, and employees are ineligible for the Program. The Program is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted.

4.  COMPANY’S DISCRETION. The Company may limit or refuse requests for Credit in the event of a local, regional, or national emergency, fraud, abuse of privileges, or violations of these Terms and Conditions, as determined in the Company’s sole discretion.

5.  RIGHT TO MODIFY OR CANCEL: The invalidity or unenforceability of any provision of these Terms and Conditions will not affect the validity or enforceability of any other provision. In the event any provision is found invalid or unenforceable, these Terms and Conditions will otherwise remain in effect in accordance with their terms as if the invalid or unenforceable provision was never included. The Company’s failure to enforce any provision of these Terms and Conditions does not constitute a waiver of that provision. The Company reserves the right to cancel, suspend, or modify the Program or any part of it, at any time and for any reason.

 In the event of an inconsistency between these Terms and Conditions and any statement contained in any Program-related materials, these Terms and Conditions will prevail and govern.
